These Terms of Service ("Terms") govern your access to and use of MuseVision (package com.trikernl.musevision, hereinafter referred to as the "App"), provided by trikernl ("we", "our", "us"). MuseVision is a curated HD wallpaper application that lets users discover, save, and apply hand-picked wallpapers to their device's home and lock screens.
Please read these Terms carefully. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
You must be at least 13 years old (or 16 in the European Economic Area) to use the App. By using the App, you represent that you meet this age requirement. The App is not intended for children under this age.
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the App on devices you own or control, solely for personal, non-commercial purposes.

The wallpapers displayed in the App are licensed to trikernl for in-app distribution. You may save individual wallpapers to your personal device storage and apply them as your home or lock screen wallpaper for personal use.

By using the App you acknowledge that ad revenue is what enables the App to remain free. You agree not to:
We do not control, endorse, or take responsibility for the content of third-party advertisements. Your interaction with any advertiser is solely between you and that advertiser.
Certain high-resolution wallpapers require you to watch a short Rewarded Video Ad (or use a free unlock granted to new users) before they can be set or saved. Watching a Rewarded Video Ad does not constitute a purchase or transaction; it is a free, ad-supported method to access additional content. The unlock state is stored only on your device and is reset if you uninstall the App.
A future major update of MuseVision will introduce an AI-powered wallpaper generation feature. This feature is not active in the current production build. When the feature launches, additional terms will apply, including but not limited to:
The App, including its source code, design, branding, logo, app icon, original artwork, name "MuseVision", and all related materials, are owned by trikernl and protected by copyright, trademark, and other intellectual property laws. Wallpapers and other media displayed in the App are licensed from their respective copyright holders.
These Terms do not grant you any right, title, or interest in the App, the trademarks, or the wallpaper content beyond the limited personal-use license described in Section 2 and Section 3.
You agree not to use the App in any way that:

Your use of these services through the App is subject to their respective terms. We are not responsible for the practices of these third parties.
Your use of the App is also governed by our MuseVision Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand how we handle your information.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIKERNL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the App will be uninterrupted, error-free, virus-free, or that any defects will be corrected. We do not warrant the accuracy, reliability, or availability of any wallpaper or content displayed in the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRIKERNL, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR DEVICE DAMAGE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM (WHICH IS TYPICALLY ZERO, AS THE APP IS FREE), OR (B) US$10.
You agree to indemnify, defend, and hold harmless trikernl and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use or misuse of the App; (ii) your violation of these Terms; (iii) your violation of any third-party right, including any intellectual property or privacy right; or (iv) any content you submit through the App (such as future AI prompts).
You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App at any time, with or without notice, including if we reasonably believe you have violated these Terms or for any other reason. We may also discontinue the App or any feature of the App at any time without liability to you.
Upon termination, all rights granted to you under these Terms immediately cease. The provisions of Sections 7, 11, 12, 13, 17 and 18 survive termination.
We may modify these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be announced inside the App at least 14 days before they take effect. Your continued use of the App after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App.
The App is distributed through Google Play. Your installation and use of the App are also subject to the Google Play Terms of Service. In the event of a conflict between these Terms and the Google Play Terms regarding distribution, the Google Play Terms shall control with respect to that subject matter.
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the App shall be resolved in the competent courts of Hong Kong, unless mandatory consumer-protection laws of your country of residence provide otherwise.
If you reside in the European Union, you may also be entitled to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect. These Terms, together with the MuseVision Privacy Policy, constitute the entire agreement between you and trikernl regarding the App and supersede all prior agreements relating to the same subject matter.
